Are you and your family renting a house or an apartment that is making you sick? Have you informed your landlord but he has told you there is nothing wrong, you're just imagining this? Well, you are not alone.

The vast majority of landlords are not willing to investigate whether or not there is a mold problem since it would cost them money to have it tested and the last thing a landlord wants to do is spend money. Therefore, the burden of proof is on you, the tenant. So what should you do when your landlord refuses to help?

Landlords are responsible for maintaining rental units, including fixing building problems such as water leaks and ventilation or heating defects which may lead to moisture problems. So the first thing you should do is promptly notify your landlord in writing of any water leaks and of your concern that mold is making you sick. If this does not generate a response or if he refuses to take any action, you will need to become more aggressive in your approach.

Next you should hire a certified mold inspector. The mold inspector will perform a visual inspection of your entire home, looking for all possible moisture issues that may have caused a mold issue. He will then sample any visible mold that he sees and take air samples of the air in your home. This will create positive, indisputable proof that you can present to your landlord in hopes that he will hire a mold remediation company to remove the mold.

Next, go to your family doctor and get his opinion. If he thinks you may have the symptoms of mold poisoning get a letter in writing. You may need this to help motivate your landlord or in court if need be.

If your landlord still refuses to help, you can hire an attorney. Make sure that you choose one with experience with the field of environmental law. A letter and a phone call from a lawyer threatening to bring legal action can be quite motivational to most landlords.

You may also want to consider contacting your local board of health. Your local building and code enforcement official may take action if building problems are not addressed. Just bear in mind that they won't respond to mold complaints, so it's important to stress the source of the water problem.

Finally if all else fails, you will be left with only one option. Move out. The last thing you want to do is make you and your family sick by staying in a moldy living environment. You can never put a price tag on your health!
